ARTICLE 1 – PURPOSE AND SCOPE

These Terms and Conditions apply to online sales made by the company Idan Zareski, a company incorporated in France, whose registered office is located at 2 Impasse Louis Pasteur, 09600, Aigues Vives, France. These terms govern the online sale of art-related products and creations made by the artist, under the brand Idan Zareski, and are intended for consumers and non-professional buyers (the "Customer") wishing to purchase products through the website www.idanzareski.com, excluding all other conditions.

These Terms and Conditions can be accessed at any time on the website www.idanzareski.com and will take precedence over any contradictory document. The version of these Terms and Conditions in effect at the time of the order will apply. Unless proven otherwise, the data recorded in the seller's system constitutes proof of all transactions with the Customer.

By selecting the checkbox, the Customer acknowledges reading and accepting these Terms and Conditions prior to finalizing the order. Validation of the order constitutes unconditional acceptance of these Terms.

 

ARTICLE 2 – ORDER

The Customer must select the products they wish to purchase on the website www.idanzareski.com by following these steps:

a) Review these Terms and Conditions, available under the "Terms of Sale" section.

b) Add products to the cart.

c) Review the cart to verify the selected items, check prices, and review shipping costs.

d) Validate the cart.

e) Provide personal details (first name, last name, address, email, and phone number).

f) Confirm acceptance of the Terms by checking the relevant box.

g) Enter payment details (credit card number, expiration date, and CVV code).

h) Respond to the confirmation request sent by the bank (via 3D Secure, such as "Verified by Visa" or "MasterCard SecureCode").

i) Review the order details, total price, and correct any errors before confirming.

j) The Customer will receive an email confirming the order.

k) The Seller is not responsible for errors made by the Customer during the online purchase.

l) The order is considered final once the Seller sends a confirmation email and the full payment is received.

 

ARTICLE 3 – CONSUMER’S RIGHT OF WITHDRAWAL

3.1. The Customer has a period of seven (7) calendar days from receipt of the product to exercise their right of withdrawal without providing a reason or paying a penalty, as long as the products are returned in their original condition and packaging. Products must be undamaged, unsoiled, and returned with all accessories, packaging, and materials.

3.2. To exercise the right of withdrawal, the Customer must email contact@idanzareski.com with their order number and desire to withdraw. Returns must be made to:

Returns will be refunded within 30 days of receipt by the Seller, using the same payment method.

3.3. The Customer is liable if they improperly exercise the right of withdrawal, such as damaging or using the product beyond what is necessary to assess its nature and functionality.

 

ARTICLE 4 – AVAILABILITY OF PRODUCTS

4.1. Products are offered subject to availability. Display of a product does not guarantee its availability.

4.2. If a product becomes unavailable after an order is placed, the Customer will be notified via email. The Customer may choose to accept a partial order, wait for the product to become available, or cancel the order. Refunds will be processed within 30 days of cancellation.

 

ARTICLE 5 – PRICE

5.1. All prices are listed in euros.

5.2. Prices on the website are in effect at the time of the order, excluding shipping costs, and may include any applicable discounts or promotions.

5.3. Prices for sales within France are inclusive of taxes (TTC). For international sales, prices are exclusive of taxes and customs duties, which are the responsibility of the Customer.

 

ARTICLE 6 – PAYMENT AND ORDER CONFIRMATION

6.1. Products remain the property of Idan Zareski until full payment is received.

6.2. Payment is required in full at the time of order.

6.3. Payment can only be made by credit card (Visa, MasterCard, etc.) via secure payment methods.

6.4. The Customer’s bank account will be debited upon order validation, and the Seller will confirm the order by email.

 

ARTICLE 7 – VERIFICATION AND SECURITY OF PAYMENTS

7.1. The Seller may review orders to prevent fraud and cancel orders at risk of fraud.

7.2. Payment is processed through a secure gateway, utilizing SSL encryption and 3D Secure verification for additional security.

 

ARTICLE 8 – DELIVERY

8.1. Delivery is available worldwide, with costs calculated based on the product, shipping method, and destination.

8.2. Delivery times are given for informational purposes and are not guaranteed. The products should arrive within 15 calendar days.

8.3. Delivery risks are transferred to the Customer once the products are received by the Customer or their designated recipient.

 

ARTICLE 9 – RESERVATION OF OWNERSHIP AND TRANSFER OF RISK

Ownership of the product is transferred to the Customer only upon full payment. However, the risk of damage or loss is transferred upon delivery.

 

ARTICLE 10 – CANCELLATION OF ORDERS

The Seller reserves the right to cancel orders from Customers with whom there is a dispute or unresolved payment issues.

 

ARTICLE 11 – LEGAL GUARANTEES

The Seller guarantees the products comply with applicable standards and are fit for normal use. Customers are entitled to legal guarantees of conformity and protection against hidden defects as provided by law.

 

ARTICLE 12 – APPLICABLE LAW AND COMPETENT COURTS

These Terms are governed by French law. Any disputes will be submitted to the competent courts in France.
